The purchaser has the right to choose a settlement agency or attorney to conduct settlement unless otherwise agreed upon. In some instances, a seller may request the use of a particular entity to facilitate a 1031 Exchange, to coordinate a sale with a purchase, or in the case of an estate sale.The settlement agency or attorney does not represent either party in a transaction, except when an attorney is hired for representation. A settlement agency may be owned and operated by an attorney, but might not offer representation. It is important to clarify your relationship with your settlement services.
The typical settlement services include facilitating the closing in accordance with the contract, communicating with all parties involved, conducting a title search, ordering required surveys, recording the deed and disbursing funds.
Your settlement should be scheduled soon after contract ratification to secure a convenient time and establish a working timeline. You should set aside about 1 hour to complete settlement. Keep in mind that settlement companies become busy during the last week of the month.
